TERMS & CONDITIONS
Please read our terms and conditions. By filling out the booking form you agree to the terms and conditions stated below.
The booking request form must be completed by the party leader the (client) who must be over 21 years of age. The return of the booking request form shall be deemed to constitute the acceptance of these terms and conditions / booking and payment procedures, by the client and shall be a warranty by the party leader that they have the authority to act on behalf of the persons named on the booking request form. Including any substitutes or additions by any subsequent agreed amendments to the booking.
The procedures and conditions will still apply even if for any reason the booking request form has not been completed by the client, e.g. in case of a late booking requested by telephone which necessitates immediate commitment.
The booking is not accepted until the completed and signed booking request form together with the appropriate deposits has been received and the acknowledged / receipt has been issued. If the booking is not accepted for any reason the deposit will be refunded in full. Amendments or cancellations of a booking by the client will be subject to the provisions of section 6 and 9 of these terms and conditions.
The accommodation can not be shared, assigned or sublet, and only those persons shown on the booking request form are permitted to stay in the property, and use the community facilities of Crescent Lakes (this is a requirement by Florida State laws).
Persons under the age of 21 years are not acceptable unless accompanied by a parent or an adult. Pets are not allowed in the villa. Failure to observe this condition will result in forfeiture of the security deposit
Deposits and payments are to be payable in accordance with the payment schedule detailed on the booking confirmation, which is explained below. Failure to comply with the payment schedule will be deemed to be cancellation by the client and will be subject to the cancellation charges as detailed in section 9
A booking / security deposit of £300 / $400 is payable at the time of booking, and the balance of the total Villa rental cost is due 12 weeks prior to arrival and any additional charges, e.g. pool heating costs
3. The Rental Period.
The Villa is available for occupation from 16.00 (local time) on the day of arrival until 10.00 (local time) on the day of departure. Vacating after 10.00 may incur charges equivalent to one days accommodation cost.
4. Rental Charges.
The Villa rental charges and the items included are as detailed in our information pack.
5. Price Guarantee.
The rental price for the Villa is fully guaranteed when the deposit has been paid and the acknowledgment / receipt has been issued.
The effective date of any amendments is the date on which details of the proposed amendment are received in writing.
7. Pool Heating.
When requested the pool heating will be switched on prior to the agreed date, to maintain the temperature of the pool heating.
Pool heating is recommended for stays between October and April - there is a 4 day minimum period for pool heating.
(i) Pool heat is charged as an optional extra. Should you wish to have pool heat after your arrival at the property there will be a £25 fee for the Management Company to attend as well as the nominated number of days for the pool heat requested. Guests must also be aware that it will take several hours for the pool to reach the correct temperature after switching on.
(ii) Guests are not permitted to adjust the pool heater controls. Any sign of tampering will result in the pool heat being turned off and payment will be forfeited. Any problems with pool heating should be reported to the Management Company immediately.
(iii) The pool heating is designed to work only at air temperatures above 55F. If the temperature falls below this, the pool heating will function at a reduced rate and will not heat the pool sufficiently. The pool heating will only heat the Pool to a maximum temperature of 15F above the ambient air temperature. For example, if the air temperature is 70F, the pool will heat to 85F, with our pool heating is set to run at a maximum of 86F. The pool heating is programmed on a timer switch, which will vary between Summer and Winter, to maximise efficiently.
(iv) We are unable to guarantee the temperature with pool heating, as this will depend on the prevailing weather conditions. If you have ordered pool heating, but the weather is warm or you decide to cancel pool heating for any other reason, no refund will be given, as the pool heat will have been turned on in advance of your arrival.
(v) The pool heater is a mechanical device, and can be subject to occasional failure. If such a breakdown was to happen, every effort will be made to repair the heater as quickly as possible. We will only refund the amount that the guest has paid for the pool heat for the days that the heater is not functioning.
(vi) If pool heat is required, it will be turned on (between 10am and 4pm) on your check-in day. Depending on the weather conditions the water can take some hours to reach optimum temperature. The Owners, the Management Company and/or their agents do not accept liability, or compensate for the loss of pool heating or lighting facilities other than as noted above.
8. The Booking / Security Deposit.
The booking deposit will convert to a refundable security deposit once you arrive at the Villa. Booking deposits are non-refundable should you decide to cancel.
The client is solely responsible for any damage or breakages that may be caused to the property and / or to its contents, and also for any loss of items in the inventory during their stay. Your initial booking deposit will convert into the security deposit once you arrive at our Villa.
The security deposit will be held against such an eventuality. And will only be returned when we have confirmation from our management company that the villa has been left in the same condition as when the clients entered the villa. The security amounts are: £300 / $400 for a 7/14 night booking £400 / $500 for a 21 night booking.
The Villa is inspected both before and at the end of each occupancy and upon confirmation that all is in order; this deposit will be refunded in full. Since it is not possible to check that accommodation before departure, the security deposit will be reimbursed as soon as possible after return, normally within 10 days of your return from vacation.
The client is responsible for the safe return of the keys to the property. If the keys are not received or they are lost during the booking, the cost of replacing the lock will be deducted from the security deposit.
Charges for damages / losses or any maintenance / repairs to the premises, equipment, amenities or fixtures necessitated by misuse will be at the discretion of RS Villas and will be deducted from the security deposited. In the event of any damage / loss which is assessed to be in excess of the security deposit the client will be held responsible for full reimbursement of the outstanding amount within fourteen days. It is important that the property is left clean and tidy at the end of the rental period. A charge will be made for extra cleaning due to guests non compliance.
Late return of deposit refunds:
If you haven’t received a refund yet, first check your bank account again. Then contact your credit card company, it may take some time before your refund is officially posted. Next contact your bank. There is often some processing time before a refund is posted. If you’ve done all of this and you still have not received your refund yet, please contact us.
9. Cleaning Fee
A cleaning fee of no more than £125 will be deducted from the deposit.
10. Cancellation by Client.
Any cancellation by the client must be notified in writing directly to RS Villas. In the event of a cancellation by the client the following charges will apply:
More than 18 weeks: 20% of the total Villa rental cost plus full booking deposit.
Between 18 and 10 weeks: 60% of the total Villa rental cost plus full booking deposit.
Less that 10 weeks: 100% of total Villa rental cost plus full booking deposit.
11. Cancellation by RS Villas.
In the unlikely event that circumstances beyond our or our agents control necessitates cancellation of the booking, we will refund in full any monies paid by the Client (without interest, compensation or consequential loss of any kind.)
12. Covid-19 Cancellations & Rescheduled Dates
If we have rescheduled your holiday due to the Covid-19 pandemic, any monies paid in full will be ineligible for a refund of any kind should you decide to cancel on your own accord. If you have paid a deposit or paid in full and are forced to cancel due to new Covid restrictions, we will provide all the necessary documentation to your travel insurance company for a claim.
If you choose not to travel without restrictions having been put in place you will not be covered by insurance and you will lose monies already paid out. We are neither responsible or liable for any refunds due to lack of travel insurance. This applies to whether you have paid in full, part payments and/or deposits.
RS Villas will not be responsible for refunds due to the lack of travel insurance.
We are not liable for refunds due to the Covid 19 Pandemic.
If we have moved your booking to another date due to Covid restrictions or otherwise you waive any future cancellation rights.
By booking or rescheduling with us you agree to these terms.
13. International Travel Requirements.
Clients are personally responsible for the provision of international travel insurance, health insurance and any other necessary documentation. Cancellation caused by clients due to incorrect documentation will be charged the relevant cancellation fee.
14. Force Majeure.
RS Villas and their agents accept no responsibilities whatsoever and no compensation or any other payment will be made if any cancellation or change of the terms of the booking becomes necessary due to war or threat of war, riots, civil commotion, terrorist activities, industrial disputes, natural and nuclear disasters, global health threats, fire and flood, adverse weather conditions, technical problems with transportation, closure or congestion of airports, alterations or cancellations of schedules by carrier, or any other events beyond our control.
RS Villas are not responsible for any matters outside of our control, such as mechanical failures or breakdown of appliances during your stay. Our management company and all of our suppliers and representatives must be given the opportunity to resolve / repair any issues brought to our attention. We will not accept any complaints filed after you have left the property. Should a problem arise whilst on holiday relating to the premises, immediate contact should be made to our management company who will seek to resolve matters speedily.
Rude / aggressive behaviour to our management company will NOT be tolerated and if persistent behaviour continues you will be asked to leave the Villa.
16. Limitation of liability.
Although every effort is made to ensure that the Villa in in perfect condition. Neither RS Villas nor their agents can accept responsibility for third party claims, accidents, damage to, or loss of property, or for any expenses incurred for any reason, including changes caused by Force Majeure, regardless of however they may have occurred, nor can liability be accepted for injury as a result of the use of the pool, however caused. We draw your attention to the pool rules on arrival at the villa - a copy of which is available upon request. Guests are specifically advised not to allow unsupervised children to use the pool. Glass is not permitted in the patio / pool area.
17. Removal of Rubbish.
The refuse is collected twice a week (Mondays and Fridays). All rubbish must be left out for the refuse collectors on the due dates. Any rubbish left after the departure of guests will be charged for removal at the rate of $25 dollars per bag.
18. CCTV & Security.
The outside of our property is protected by CCTV. You agree not to tamper, block, or touch the CCTV system whilst staying at the property. By agreeing to these terms you agree to obey and understand that the CCTV is in place to for your safety and the protection of our property.
19. Pest Control.
Guests are reminded that periodically the management company may require access to the property during your stay in order to carry out pest control. This is for your benefit. Refusal to comply with this request will result in an extra call out charge of $50 dollars which will be deducted from the security deposit held by the owner.
As some guests may be sensitive to allergies we do not allows pets into our villa.
The contract is subject to and shall be in accordance with the laws of England and the parties hereby submit to the exclusive jurisdiction of English Courts.
22. Terms & Conditions.
We reserve the right to change or modify any of the terms and conditions contained in the terms & conditions or any policy or guideline of the websites, at any time and in our sole discretion. Any changes or modification will be effective immediately upon posting of the revisions on the websites, and you waive any right you may have to receive specific notice of such changes or modifications. Your continued use of the websites following the posting of changes or modifications will confirm your acceptance of such changes or modifications.
